This policy applies to you if you are:

  • A user of our Website (the “Website”), including when you visit the Website and interact with us through it;
  • A representative of a supplier, service provider, or any other business or organization that we interact with in the ordinary course of business (collectively “Business Contacts”); and   
  • A customers purchasing our products and services via the Website (“Customers”). 

Please note that this Privacy Policy may apply to you in different ways depending on how you interact with us and there may be cases where different sections of this policy overlap, for example where you are both a Website user and a Customer. In such cases, the different sections of this Policy are intended to be complementary rather than mutually exclusive. It is important that you read this Policy, together with any other privacy policy or notice we may provide on specific occasions when we are collecting or processing your personal information, so that you are aware of how and why we are using such information. 

Please note that this Policy does not form part of any contract of services. We reserve the right to update this privacy policy at any time, and we will provide you with a new privacy policy when we make any substantial updates. We may also notify you in other ways from time to time about the processing of your personal information. 

2.        THE PERSONAL INFORMATION WE HOLD ABOUT YOU   

Personal information means any information about an individual from which that person can be identified and does not include information where the identity has been removed (anonymous data). 

Further details of the types of personal information that we collect and hold as well as the purpose(s) of processing are below. Please note that we do not intend on collecting any sensitive or special category personal information about you (such as information about your health, race or political affiliations) and we ask that you do not provide any such information to us, whether through the Website or otherwise. Our Website, products and services are also not intended for use by legal minors and we do not deliberately collect or use the personal information of minors.

If you are a Website user, then we will collect and process the following types of personal information:

  • Information submitted in the course of contacting us, including where you submit an enquiry via the Website or contact us using another medium, such as your name, title, address, telephone number and email address. Where you are acting as business representative, then we may also collect the identity of your employer, location of employment and role. In each case, we will also collect information regarding the nature of enquiries submitted and the contents of any related communications; 
  • Information regarding your marketing preferences, including where you sign up to receiving promotional emails from us via the Website and where you unsubscribe from receiving further communications from us; and 
  • Technical information regarding your use of the site, including details of your visit and how you interacted with the site, IP address, geolocation, and device and browser type (please see the “Cookies and Tracking Technologies” section below for further information).
If you are a Business Contact, then we will collect and process the following types of personal information:
    • Contact details including name, title, address, telephone number and email address, identity of employer, location of employment and role;
    • Details and contents of communications; and
    • Financial information including invoices, financial institution and bank account details.
    If you are a Customer, then we will collect and process the following types of personal information:
      • Product enquiry information, including where you submit an enquiry via the Website or contact us using another medium;
      • Personal contact details such as name, title, billing and delivery addresses, telephone number and email address; 
      • Details of your purchases, including products ordered, time and amount of purchases, sales tax calculations, shipping cost calculations and delivery information; 
      • Financial information for the purposes of processing payments, including your financial institution and the number of credit or debit card used for payment or necessary login information for PayPal, ShopPay, GooglePay, or other online payments provider; 
      • Shipping updates, for the purposes of notifying you with updates about outstanding orders; and 
      • Communications information, including the time and content of communications with us regarding prospective or existing product orders.
      3.     HOW IS YOUR PERSONAL INFORMATION COLLECTED?   

        We typically collect personal information directly from you, including when you provide your information by interacting with us through the Website or by initiating contact through other channels. 

        In come circumstances we may also collect your personal information indirectly, including from service providers we engage in connection with operation of the Website (please see the “Cookies and Tracking Technologies” section below for further information), or if you are a Business Contact from your employer. 

        4.    PURPOSES FOR WHICH WE USE YOUR PERSONAL INFORMATION   

        We will only use your personal information when we have a specific reason to. Most commonly, we will use your personal information in the following circumstances: 

        • where we need to, to enter into or perform a contract with you; 
        • where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests; and  
        • where we need to comply with a legal or regulatory obligation. 

        We have set out below, in a table format, a description of the ways we plan to use your personal information, and the legal basis on which we rely on to do so. We have also identified what our legitimate interests are where appropriate.   

        Note that we may process your personal information listed (please see “THE PERSONAL INFORMATION WE HOLD ABOUT YOU”) on more than one lawful basis depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific lawful basis we are relying on to process your personal information.

            Please note that some of the above grounds for processing identified in the tables above will overlap and there may be several grounds which justify our use of your personal information. 

            • If you fail to provide personal information 

            If you do not provide full and accurate information when requested, we may not be able to perform the contract we have entered into with you (including dispatching your order), or we may be prevented from complying with our legal obligations (such as to comply with tax reporting obligations).   

            • Change of purpose   

            We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. 

            Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.     

            5.        COOKIES AND TRACKING TECHNOLOGIES      

            This Website uses cookies and other tracking technologies for different purposes. The use of such technologies may involve the processing of your personal information as a user of the site, including in relation to how you interact with the site (such as clickstream data and the amount of time spent on different site pages) and technical information regarding how you access site content (including your IP address, geolocation and information relating to your device, operating system and browser).

             

            6.   INFORMATION SHARING   

            We may share your personal information with third parties where appropriate, including in the ways described below.

            • Suppliers and service providers 

            We will share your personal information with third party suppliers for the purposes of providing our service offering including third parties involved in the order fulfilment process, such as product manufacturers and shipping and logistics companies. We may also share our personal information with service providers that we rely on for specific purposes, such as to support our Website, enable digital communications, enhance marketing practices and techniques, process payments and store business information.     

            • Regulatory and governmental authorities

            Where necessary, we will share your personal information with external authorities. This will typically be limited to sales tax calculations and reporting but could involve dealing with other governmental authorities or law enforcement agencies on a case-by-case basis.

            • Our professional advisors

            We may share your personal information with our professional advisors as appropriate, including for the purpose of obtaining legal, accounting and other types of professional advice.

            • Other third parties 

            We may also share your personal with a prospective purchaser and its professional advisors in the context of the possible sale or restructuring of our business. 

            • International transfers of personal information 

            Our business only operates in the continental United States and does not currently accept orders from overseas customers. All of our information is stored on servers located in the United States.

            7.   INFORMATION RETENTION     

            How long will you use my personal information for? 

            We will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. 

            In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further policy to you.   

            8.   YOUR RIGHTS IN RELATION TO YOUR PERSONAL INFORMATION  

            Your duty to inform us of changes 

            It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your working relationship with us.   

            Your rights in connection with your personal information 

            In certain circumstances you may have rights under data protection laws, subject to the rules of entitlement and exemptions under those laws. The following rights may be available to you, depending on your location:   

            • Request access to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.  
            • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected. 
            • Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below). 
            • Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes. 
            • Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.  
            • Request the transfer of your personal information to another party.   

              If you want to review, verify, correct or request erasure of your personal information, object to the processing of your personal information, or request that we transfer a copy of your personal information to another party, please contact us.     

              What we may need from you 

              We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it. 

              Your right to withdraw consent 

              In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please contact us. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law. 

              Your right to complain

              We would always welcome the opportunity to address any complaints in the first instance and would ask that you contact us with any complaints or concerns. However, you may have the right to complain to a supervisory authority regarding the use of your personal information, such as the US Federal Trade Commission.
